Terms & Conditions

1. Scope of Application

1.1 The following General Terms and Conditions (GTC) apply to all contracts concluded between Felix Urbauer (hereinafter "Videographer") and the customer for the creation of wedding videos and other cinematic content.

1.2 Deviating conditions of the customer are not recognized unless the videographer expressly agrees to their validity in writing.

2. Contract Conclusion

2.1 The offers of the videographer are subject to change and non-binding.

2.2 A contract is only concluded through written order confirmation from the videographer or through actual performance of the service.

2.3 Changes or additions to the contract require written form to be effective.

3. Scope of Services

3.1 The exact scope of videography services is determined by the individual offer or order confirmation.

3.2 The videographer reserves an appropriate artistic scope in implementing the order.

3.3 The selection of image recordings is at the discretion of the videographer. The customer has no claim to the release of all raw material.

4. Prices and Payment Terms

4.1 The prices agreed at the time of contract conclusion apply.

4.2 Upon order placement, a down payment of 30% of the total amount is due. The remaining amount is to be paid within 14 days after receipt of the final video products.

4.3 In case of late payment, the videographer reserves the right to charge default interest at the statutory rate.

5. Cancellation and Schedule Changes

5.1 In case of cancellation of the order by the customer, the following cancellation fees apply:

  • Up to 6 months before the agreed date: 20% of the agreed fee
  • Up to 3 months before the agreed date: 50% of the agreed fee
  • Up to 4 weeks before the agreed date: 75% of the agreed fee
  • Less than 4 weeks before the agreed date: 90% of the agreed fee

5.2 For schedule changes, a processing fee of €100 will be charged. The videographer reserves the right to decline the new date if it is already otherwise allocated.

6. Delivery Time and Processing Duration

6.1 The processing time for a wedding video is typically 8-12 weeks from the event date, depending on the scope of material and current order situation.

6.2 Delays in processing caused by force majeure or technical disruptions extend the delivery time accordingly. The videographer will inform the customer about such delays.

7. Copyright and Usage Rights

7.1 The videographer holds the copyright to all video recordings created as part of the order according to copyright law.

7.2 Upon full payment, the customer acquires simple, non-transferable usage rights to the video recordings for private use.

7.3 The video recordings may not be edited, altered, or used for commercial purposes without written permission from the videographer.

7.4 The videographer reserves the right to use the created video recordings for their own advertising purposes, portfolio presentation, competition submissions, or editorial purposes, unless the customer expressly objects.

8. Liability

8.1 The videographer is liable for their own fault as well as the fault of their agents only in cases of intent or gross negligence.

8.2 The videographer is liable for damages caused by equipment failure or loss or data loss only up to the amount of the agreed fee.

8.3 The customer bears the risk for all circumstances not within the videographer's sphere of influence, such as weather conditions, availability and cooperation of third parties, or other unforeseeable obstacles.

9. Data Protection

9.1 The videographer collects and uses personal data of the customer for order processing.

9.2 The customer agrees to the collection, processing, and use of their personal data for the purpose of contract processing.

9.3 The customer has the right to withdraw their consent at any time. Details about data processing and data subject rights can be found in the Privacy Policy.

10. Final Provisions

10.1 German law applies.

10.2 Place of performance and jurisdiction is Munich, provided both contracting parties are merchants.

10.3 Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions remains unaffected.
